By accessing or using our website, platform, and services including WhatsApp Business API, automation tools, CRM, chatbot builder, and related services (collectively, the "Services"), you ("User," "Customer," "Client") agree to these Terms & Conditions.
If you do not agree with these Terms, please discontinue use of our Services immediately.
1. Eligibility
* You must be at least 18 years old to use our Services.
* You confirm that you have the authority to accept these Terms on behalf of yourself or your organization.
* Use of WhatsApp and Meta platforms must comply with their official policies and guidelines.
2. Services Provided
InboxWA provides:
* WhatsApp API integrations and automation
* CRM and customer management tools
* Chatbot builder and workflow automation
* Marketing campaigns and notifications
* Integration with third-party platforms
* Analytics, reporting, and support services
We reserve the right to modify, update, or discontinue any part of the Services at any time.
3. Account Registration & Security
* You must provide accurate and complete information during registration.
* You are responsible for maintaining the confidentiality of your login credentials.
* All activities under your account are your responsibility.
* InboxWA is not liable for unauthorized access due to your negligence.
4. Acceptable Use Policy
You agree NOT to:
* Use the Services for illegal, fraudulent, or abusive purposes
* Send spam, unsolicited, or bulk messages without proper consent
* Violate WhatsApp, Meta, or third-party platform policies
* Upload malicious code, viruses, or attempt unauthorized access
* Misuse APIs or automation in violation of laws
Violation may result in **immediate suspension or termination without refund**.
5. Pricing, Payments & Refunds
* All prices are in INR (₹) and exclusive of applicable taxes
* Subscription fees must be paid in advance
* Minimum recharge requirements may apply
* Add-on services are billed separately
Refund Policy:
* Payments are non-refundable once services are activated
* Refunds will only be provided if required by applicable law
Failure to pay may result in account suspension or termination.
6. WhatsApp Verification & GreenTick
* We assist with WhatsApp Business verification and GreenTick application
* Approval is solely controlled by Meta (WhatsApp)
* We do **not guarantee approval**
* Fees paid for this service are non-refundable once processed
7. Data & Privacy
* We handle your data as per our Privacy Policy
* You are responsible for obtaining proper consent from your users/customers
* You agree that InboxWA may process message logs, automation data, and CRM data to provide Services
8. Intellectual Property
* All software, branding, and platform content belong to InboxWA
* You are granted a limited, non-exclusive, non-transferable license to use the Services
* You may not copy, modify, distribute, or reverse-engineer any part of the platform
9. Third-Party Integrations
* Our Services may integrate with third-party platforms (Meta, Shopify, etc.)
* We are not responsible for their performance, outages, or policy changes
* Your use of third-party services is subject to their respective terms
10. Service Availability
* We strive to maintain high uptime but do not guarantee uninterrupted service
* Downtime may occur due to maintenance or third-party issues
* InboxWA is not liable for any losses caused by service interruptions
11. Limitation of Liability
To the maximum extent permitted by law:
* InboxWA is not liable for indirect or consequential damages
* Our total liability is limited to the amount paid by you in the last 12 months
We are not responsible for:
* Business losses due to downtime
* WhatsApp verification delays or rejection
* Misuse of APIs or Services by users
12. Indemnification
You agree to indemnify and hold harmless InboxWA and its team from any claims, damages, or liabilities arising from:
* Your misuse of the Services
* Violation of these Terms
* Violation of applicable laws or platform policies
13. Termination
* You may terminate your account at any time by contacting us
* We may suspend or terminate your account if you violate these Terms or fail to make payments
* Data may be deleted after termination, subject to legal obligations
14. Governing Law & Jurisdiction
* These Terms are governed by the laws of India
* Any disputes shall be subject to the jurisdiction of courts in **Bengaluru, Karnataka**
* Arbitration may be required prior to legal proceedings, as per applicable laws
15. Changes to Terms
We may update these Terms at any time. Updated versions will be posted with a revised "Last Updated" date. Continued use of the Services constitutes acceptance of the updated Terms.
